They formed a queue in front of the banks: is there a lien on the pensioner's transport?

As inflation approached 80 percent, the number of promotions granted by banks to pensioners exceeded 7,000 lira, and complaints about foreclosure of money deposited in the account began to mount. It is found that deposited funding is automatically confiscated from retirees with e-lien registration.

After the decision of the Supreme Court, the old-age pension could not be attached, but its promotion led to discussions. While some lawyers point out that a lien on the promotion is not possible because it is an addition to the pension, others argue that it will be possible because it is an income separate from salary. What is certain is that we will see many new extradition lawsuits on this subject in the coming period.

RETURN CASES WILL BE OPENED

Economist and banking expert Erol Taşdelen issued a statement to publictv.com.tr’s Nuray Tarhan, noting that there is no precedent regarding the possibility of foreclosure on the promotion: “As promotion-style payments have the status of additional income have, except salary, they can be disqualified by court, but promotion is not dependent on salary As it is a payment, there is no model court order yet. In the near future it is likely that extradition lawsuits will be filed for confiscation of this type of carriage. The judiciary should express an exemplary opinion so that pensioners do not fall victim to such opportunities,” he said.

Noting that some banks were struggling to support the annuity because they tied the account to the loan, he said:

“Some banks link the pension account to the credit account. This is common practice at all banks so that the system automatically receives credit installments, but the account details should not prevent the salary from being transferred to another bank. Some banks, including the public sector, are moving in this direction when using credit. You also receive a promise from pensioners, but these contracts are legally incomplete because they are unilaterally in the interest of the bank. Since the loan is granted to the person, the source of the loan to be paid cannot be a pension, the pensioner can also have other income such as rent. As a bank, you cannot get a guarantee that your salary will be paid to us until the loan has expired. Because this type of commitment applies in general consumer loan agreements.”

Victimization of BOT RETIREMENT CONTINUES

Taşdelen emphasized that retirees face further victimization, especially in banking, and continued her words as follows:

“The most damaged segment is the ballot box retirees. Because the funds granted these pensioners neither vacation pay nor salary increases. In addition, it is not allowed to transfer salary to other banks. Pensioners could not receive these payments from the institutions where they had worked for years and retired. Bank boards and ballot box boards betray their friends. Come on, the Treasury pays the vacation pay while the banks give the payroll out of their own structure. Banks should give raises to their own retirees. İşbank has been granting its pensioners salary increases for years. In 2022, he began giving the holiday pay by leading the way. Garanti BBVA paid out the holiday allowance retrospectively. He announced that based on the reactions received, he will start a salary promotion in 2022, but there is no promotion for retirees yet. Yapı Kredi granted a salary increase but did not renew those that expired after the last increase. No vacation pay now. Şekerbank gives promotions but no holiday bonuses. Banks like Akbank do not grant vacation pay or pay rises. There are thousands of retirees from the aggrieved fund.”
